The Texas Department of Licensing and Regulation (TDLR) adopted new rules March 3, 2021. The changes summarized below address new consent requirements for breast massage and human trafficking prevention continuing education updates. The new rules are effective April 1, 2021.
Breast Massage
The new rules modify breast massage under the ethics section. The rule change now requires written consent to be given before each breast massage session:
(c) A licensee shall obtain a new written consent, signed and dated by the client, before each session in which breast massage of a female client will be performed. This written consent may be documented on a new consultation document or in a separate document. (Page 28 of the linked document)
Human Trafficking Continuing Education
(a) Notwithstanding any other provision in this chapter, a human trafficking prevention training course approved by the Health and Human Services Commission (HHSC) in accordance with Occupations Code, Chapter 116, will count as acceptable continuing education. (Page 26 of the linked document)
Our last communication to you about the human trafficking prevention course sent in July 2020 announced the adoption of the new continuing education requirement. At that time, TDLR only had one approved course and was in the process of accepting more. Here is an expanded list of approved human trafficking prevention courses. The March 2021 adopted rules also clarify that no more than three credit hours per license term can be awarded for human trafficking prevention training.
